Terms of service.

1. Acceptance

By using hec.nz or HEX Platform™, you accept these terms. If you do not accept them, do not use the site or the platform.

2. About these terms

These terms govern general use of the public website and act as the umbrella terms for HEX Platform. The substantive commercial and data-processing relationship for any specific engagement lives in the engagement letter and any associated data-processing agreement signed between Health Economics Consulting NZ Ltd ("HEC") and the client. Where those documents conflict with these terms, those documents prevail.

3. Eligibility

HEX Platform is intended for use by health-economics professionals and the client teams they work with. You must be at least eighteen years old to use it. Access is granted to named users at the client's direction; sharing of credentials is not permitted.

4. Account and access

You are responsible for keeping your credentials secure and for any activity under your account. Notify us promptly at [email protected] if you suspect unauthorised access.

5. Intellectual property

HEC retains all intellectual property in HEX Platform, including its source code, infrastructure, documentation, and brand. The client retains intellectual property in their input data, parameter sources, and modelling assumptions. Outputs generated during an engagement (models, dossiers, simulation results) are owned per the engagement letter — typically the client.

We do not use client modelling data to train models, do not share it with other clients, and do not licence or sell it.

6. Payment

Engagements are invoiced monthly in advance under the retainer agreed in the engagement letter. Payment terms, invoicing currency, and any agreed pass-through expenses are documented there.

7. Acceptable use

You must not: attempt to reverse engineer the platform, run automated load testing or scraping, upload malicious content, or interfere with platform integrity. You must not use the platform to process personal data outside the scope of the engagement.

8. Availability

We aim for high availability but do not guarantee uptime on this public site. Service-level commitments for HEX Platform during active engagements are set in the engagement letter.

9. Disclaimer

10. Liability

To the maximum extent permitted by law, HEC is not liable for indirect, incidental, special, or consequential damages arising from use of this site. For engagements, liability caps and exclusions are set in the engagement letter.

11. Termination

We may suspend or terminate access for breach of these terms. Termination of an engagement is governed by the engagement letter.

12. Governing law

These terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction, except where a client engagement specifies a different forum in the engagement letter.

13. Changes

We may update these terms. Material changes will be reflected in the "last updated" date at the top of the page. For active engagements, material changes will be notified to the client contact directly.
